These Terms of Service (the "Terms") govern your access to and use of the website and online store operated by Ozel Brands LLC ("Özel", "we", "us" or "our"), including all related content, features, tools, products and services (the "Services"). By visiting or using the Services, or by placing an order, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, please do not use the Services.

1. Eligibility & Your Account

By using the Services you confirm that you are at least the age of majority in your place of residence, or that you are using the Services with the consent of a parent or guardian. When you place an order or create an account, you agree to provide information that is accurate, current and complete, and to keep it up to date. You are responsible for maintaining the confidentiality of your account and password and for all activity under your account. You may not transfer, sell or assign your account to anyone else.

2. Our Products

Each Özel piece is handcrafted, so slight variations in colour, finish and detail are natural and are part of the character of the work. Colours may also appear differently depending on your screen. We have made every effort to represent our products accurately, but we do not warrant that the appearance or quality of a product will exactly match how it appears online. All product descriptions, prices and availability are subject to change at any time without notice, and we may limit or discontinue any product at our discretion.

3. Orders & Acceptance

When you place an order you are making an offer to purchase. We reserve the right to accept or decline any order at our discretion, and your order is not confirmed until we accept it and your payment has been processed. If we cannot accept, need to change, or cancel an order, we will try to contact you using the details provided at checkout. You represent that your purchases are for personal use and not for commercial resale.

4. Pricing & Payment

Prices are shown in the currency displayed at checkout and are subject to change without notice. The price that applies to your order is the price shown at the time the order is placed, as set out in your order confirmation. Unless stated otherwise, prices do not include applicable taxes, customs duties or import charges, which may be payable by you. You agree to provide valid, current payment information and confirm that you are authorised to use the payment method you provide.

5. Shipping, Returns & Refunds

Shipping timelines, charges, returns, exchanges and refunds are governed by our Shipping & Returns policy, which forms part of these Terms. Delivery times are estimates only and we are not responsible for delays caused by carriers, customs or other events outside our control.

6. Intellectual Property

All content on the Services — including text, images, graphics, logos, designs, and the selection and arrangement of that content — is owned by Özel or its licensors and is protected by applicable intellectual property laws. You may use the Services for your personal, non-commercial use only. You may not reproduce, distribute, modify or create derivative works from any part of the Services without our prior written consent. "Özel" and our logos are our trademarks and may not be used without permission.

7. Acceptable Use

You agree to use the Services only for lawful purposes. You may not use the Services to break any law, infringe the rights of others, transmit harmful or misleading content, upload malware, harvest others' personal information, or interfere with or attempt to gain unauthorised access to the Services. We may suspend or terminate access if we believe these Terms have been violated.

The Services may contain links to, or tools provided by, third parties that we do not control. We are not responsible for the content, accuracy or practices of third-party sites or services, and any use of them is at your own risk and subject to the third party's own terms.

9. Relationship with Shopify

Our store is powered by Shopify, which enables us to provide the Services to you. Any purchase you make is made directly with Özel. Shopify is not responsible for any aspect of the transaction between you and us, including any loss or damage resulting from products or services purchased.

10. Disclaimer of Warranties

Except as expressly stated by us, the Services and all products offered through them are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Services will be uninterrupted, secure or error-free. Some jurisdictions do not allow certain warranty exclusions, so some of the above may not apply to you.

11. Limitation of Liability

To the fullest extent permitted by law, Özel and its directors, employees, affiliates and service providers will not be liable for any indirect, incidental, special, punitive or consequential damages, or any loss of profits, revenue or data, arising from your use of the Services or any product purchased through them. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify and hold harmless Özel and its affiliates, officers, employees and agents from any claims, losses, liabilities and expenses (including reasonable legal fees) arising out of your breach of these Terms, your violation of any law or the rights of a third party, or your use of the Services.

13. Governing Law & Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Maryland, without regard to its conflict of law provisions. You agree that the state and federal courts located in Maryland will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services.

14. Changes to These Terms

We may update these Terms from time to time. The most current version will always be posted on this page, and material changes take effect when posted. Your continued use of the Services after changes are posted means you accept the updated Terms.
